Police arrest, charge man with lewd and lascivious behavior

A Fort Myers man is facing charges after he allegedly sexually assaulted an underage girl.

On June 12, the Sanibel Police Department arrested and charged Smith Dumornisse, 19, of 3080 Royal Palm Ave., with one count of lewd lascivious behavior victim 12 years or older younger than 16 years of age offender 18 years older. He remains in custody at the Lee County Jail on $75,000 bond.

According to the police report, a woman visited police headquarters on May 4 and stated that she wanted to report a sexual assault against her minor daughter by an older male. She told police that the incident happened on or about Feb. 17 at approximately 3 p.m. in the back seat of his vehicle.

The woman reported that the male was allegedly 16 years old.

Police provided the woman with a sworn statement and intent to prosecute form. The woman said she wanted to discuss the issue with her husband before going any further with filing the complaint.

She added that she wanted to confront her daughter about it to gather more information.

On May 5, the woman returned with her husband to file a formal complainant.

The report states that a recorded statement was provided to police.

Sanibel police conducted an investigation into the allegation and partnered with the state's Child Protective Team, city officials reported. Probable cause was established to charge Dumornisse.

He was taken into custody and transported to the jail, where he was booked.

Dumornisse has a court appearance scheduled for July 16.
